Substancial Change in Circumstances

Has anyone had successful custody change without some kind of physical abuse? SD11 wants to live with DH and I now and BM won't even discuss it. SD11 has been diagnosed with Disruptive Behavioral Disorder and her counselor informed DH today that she is not making any progress, will not talk, and she's going to have to refer her to someone else. DH has joint legal custody now, but we want physical custody. What do we need in order to make this happen??
BM does the regular stuff - talks bad about me and DH to SD11 (even though she's not supposed to via court order, makes SD11 feel bad for having a good time at our house, etc.
It depends on which state
It depends on which state you're in. Sometimes though, the court will take into consideration what the child wants once they reach a certain age.

Also, if you could get the counselor to testify on your behalf, that could go a long way in persuading a judge. She may charge a fee, but it'd be well worth it.
