Alright- who can write a good email to CS?
Follow up to my last post.
I am going to send an email to CS from DH's account.
Not sure if there is anything we can do about it now, but I am going to at least send an email.
MSD was 18 and most likely not attending school at all.
According to law MSD was suppose to be attending school full time.
(2) The child ceasing to attend an accredited high school on a full-time basis after attaining the age of majority, if the child support order requires support to continue past the age of majority only if the child continuously attends such a high school after attaining that age;
So MSD was 18, not living with BM and not attending school and DH paid BM about $1000 in CS for MSD during this time.
DH owes back child support from it not getting re-evaluated when SS graduated. So BM is sitting on a balance from that.
So maybe while DH cant actually get money back from BM, he can possibly get a credit towards the back support.
AS far as MSD not attending school- not sure what proof we would need and what qualifies.
Any good tips when sending the email?
We are in a big city and I dont want the caseworker to look at the email and think Oh here is another guy trying to get out of paying child support.
Any help with wording the email will be greatly appreciated!

Can your DH contact the school and get proof that she stopped attending and when?
I agree with Missstresss, you are going to want to file something official (modification or request to terminate, which ever applies), not just send an email.

He is no longer paying her. CS ended in May which was her "Graduation" date.
MSD turned 18 in November, but as long as MSD was attending H.S full time CS was to continue.
But from the looks of it, MSD was NOT attending H.S.
So DH paid CS from Novemeber- May when MSD was 18, not living with BM and not in H.S.

First, I would research CS for your state (or contact CSE) and find out if getting it credited to his arrears is even possible. Some states just say you are screwed if you overpaid or you have to sue BM for the overpayment.

I dont think we would want to much too much into this (time, money, lawyer) just to stick it to BM, even though she deserves it.
She knew MSD wasn't going to school and wouldnt graduate and she had no problem collecting the funds. I am annoyed by that. But I believe in karma.

Small claims court! File for the overpaid CS and court costs. Get the information to prove MSD wasn't attending school. Go to the last school you know she was attending and ask for attendance records. Also inquire if her school records had been sent to another school which could mean she transfered schools but if the records were never sent out that means she did drop out, officially or unofficially.

For proof usually all you have to do is call the school and get a printout of the list of days missed…or maybe a list of days she attended if thats easier
