So...
As I have explained before, there is a mortgage mod that Skeletor wants him to sign. He promised me he wouldn't sign it. As she has been trying to mod her house for the next 35 years with two different mortgages, FDH has been trying to refinance his house to take her OFF of it so that we can move on with our lives. Apparently, Colorado (where his house is located) is not a community property state and will not recognize the community property agreement that is in place between FDH and Skeletor. That means that they have to get a quit claim deed and have it signed. Well even though their agreement says that the parties are required to sign anything or assist with anything for the enforcement of the document, she won't sign his unless he signs hers. She said, in writing that if he doesn't sign hers, she will pay the lower amount anyway. The purpose of the agreement is to SEPARATE the properties, so he is not required by the agreement to sign hers, but she is required to sign his. We can take her to court, we will win and she will have to pay our attorney's fees. The problem is that FDH will lose his interest rate for his refi if it is not done now. His credit will be further screwed up and who knows how long it is going to take to get it fixed from BM's mortgage indiscretions. I want her name OFF the house in Colorado far more than I care if his name is on her crap. We don't want to have to go to court because the kids already believe their mom that she is a victim and their "rich" dad is just trying to screw her.
I feel so defeated. I hate this woman so much after all of this. I envy all of you whose BM's are deceased. I wish ours would become that way. I wish she would just go away and leave us alone.

I remember going through that myself, it is very stressful but it does pass. I actually had my parents get my mortgage in their name cuz my ex wouldn't sign off of it just to turn around and have to sell it after i remodeled it because i had to move into the divorce house cuz my ex was letting it go into foreclosure. He was getting his equity by living there 10 months for free. He was a dirty bastard. I made a huge profit on the house i had to sell, fixed up the divorce house and sold it right away and made another huge profit. Have faith things find a way of working out for the good even though it seems so shitty right now.

Why, if they are divorced, are the homes they own together not being SOLD to pay off what is owed since obviously they cannot agree on what to do with either property?
Seriously, take her to court, and if she cannot afford to buy his half of the house, refi in her OWN name ONLY, then sell the damn thing.
You don't have to have an attourney to go to court. You just have to know the law and have the proof, documentation, and ability to demonstrate how the law applies to your specific case.
Sometimes people can't agree, which is why there is a court system. Go to court over this matter, then DO what the judge says and get this issue resolved one way or another and move on with your lives.

They have already agreed she gets the Louisiana house that she lives in and he gets the Colorado house which is a rental property. The issue is with the mortgages. She has refused all along to refinance her house. His name is still on it and there is nothing that he can do about it because the mortgage company won't just accept the court order and take his name off of it. They say that the court order is an agreement between Skeletor and FDH but that both still have an existing contract with THEM. It is a freaking nightmare.
