bm sending to court over sd bday

the ex wants to come up for the sd bday. and she wanted to come up 4/28-5/2. we told her that would not work with the plans and can come 4/16-4/18. she now is claiming to take to court and has proof. her only proof is emails asking about that week and us telling her we will figure out our plans and let her know. should we even have to worry about this. the only that i am worried about is can a judge give her custody of the sd for the 28th-2nd living in a hotel room? or will he only be able to grant visit not how visit will happen?

the agreement says she can come and visit but we all have to agree when. she is demanding not comprimising. she wants her dates then we told her not good for us. then told her what weekend was good and she doesn't like that weekend. so now she is saying shes coming up when she wants and she will have her daughter and thats final. how is that all of us agreeing.
