How to reduce Child Support - advice needed please...

Zoie's picture

I need to know if anyone has had their CS reduced and what does it take to make this happen. It seems to be very complicated and I dont know why. I put a call into our lawyer and he said if BM agrees to it then it's simple, but if she doesn't then it will cost DH quite a bit of money to go to court...

I'm confused, if we have his annual tax assessments for the past few years that states he's made less money then what's the problem...why do we need to battle this out in court???

Does anyone know how to deal with this without it costing us a fortune....

Any help would be greatly appreciated.... thank you.... Z Smile

P.S. we live in Canada

We live in CA and DH got his reduced by $400. Its due change in his income and new additions to our family, we have a baby girl and another one on the way. He had to get a lawer and it was pricey but on the long run, the $400 itll save us about $50,000 so to me its worth it that we got it reduced. They settled outta court and she wanted him to pay all her attorney fees which was about $12,000 and he got away with 2k(payments for 12 months) We had strong facts(her drama for the past couple of years that makes her look like shes insane) in the declarations against her so I guess she got afraid of and decided to settle out of court. If your're dealing with a crazy BM and you guys have a lot of facts thats a good stradegy to get her to settle. Otherwise if DH would of went to court he would of probably walked out with almost no CS reduction and having to pay ALL her attorneys fees. And yeah DH spend about 4K for his attorneys but I think it was well spent.

I think it's a shame...we pay $900.00 per month and we drive 1 1/2 one way EOW and BM pays nothing and drives 6 minutes. she is unemployed and does nothing at all to enhance her child's life.

I mean come on why in the world do we have to fight to have this changed. It should be a simple process...1-you provide your Income Tax Assessment and boom CS is changed...why all the hoopla...
Sad Sad Sad Sad Sad Sad
