So BM is taking DH to court for "contempt of court" for 1) not paying $2500 a month on a $4000 a month before taxes salary (yep, he was stupid to agree to that - he told her that he would try his best and she "promised" never to go after him if he couldn't give her that much each month) 2)because I cancelled the skids insurance after she basically told us she wouldn't follow through with the $15 per visit copays, and 3) because he won't just sign over the deed to the house to her so she can modify the loan. We gave her an agreement that DH would stay on the loan with her (she can't refinance) until the youngest turns 18, but that wasn't good enough.

I guess BM messed up the proof of service and it got sent back to her...twice (based on the court's online summary). She shows up yesterday and because there was no proof of service, the judge moved the date to May 7, as long as she served DH and filed a proof of service. We found this out on the way to court and decided not to show up. There is no benefit to DH AT ALL to going to court - we've already given her a written agreement to help her stay in their house. We just turned the car around and it was the best decision. The judge has no proof that DH was served or knew about the court date so he is in no trouble and it gives us more time to prepare and file a response to her contempt papers. So BM texts and leaves a voicemail message for DH asking where he was, saying that nothing could be decided because he wasn't there, and that she needs to serve him again so he needs to tell her where he'll be next week. He has been working at a job site in her town (an hour away) recently and she literally expects him to drive over to her house to get served. I told him that he had no obligation whatsoever to make it convenient for her. She knows where we live and she is so lazy, I can almost promise that she'll drive down here kicking and screaming. I may just tell her that he isn't here the first and second time she comes by too:) Why the hell would she think that we are going to give her any information or make serving DH easy on her? Does she not realize that she has been nothing but a complete bitch and is now taking DH to court after promising not to?
