My SO emerged from court yesterday as a very happy and satisfied man. Helped that BM walked in very entitled and then angered the magistrate.

Her financial paperwork indicated she spent in excess of $300.00 a month on her hair and nails, $250.00 a month on gifts, $500.00 a month on eating out and $750.00 a month on clothing.

SO's attorney pointed out that she had changed jobs, according to her tax returns 2.5 years ago increasing her salary from 52K a year to 71k+ (she receives bonuses annually). The CS order in place stated any increase in income, above the 4% COL raise increase, must be reported to the court. When asked why she didn't report it she told the magistrate it was no one's business how much money she made.

End result: It was determined that SO overpaid CS for the last 2 years by $1000.00 a month. For while he is on unemployment BM must pay him $800.00 a month in cs and pay for insurance for both of the children. SO must provide proof to the court he is looking for work, his first reporting he did yesterday, submitting names of companies, who he spoke with, when interviews were etc.

The $800.00 a month is a temp order, each month he must submit his proof of job hunting and supply proof that while he is going to school he is passing. So at the end of each semester he has to submit his grades and they must be a c+ or higher.

In addition to the $800.00 a month in CS, BM must pay him an additional $500.00 a month until the $24k in over paid CS is refunded. So all totalled, $1300.00 a month is what SO will receive, garnished from her wages and retroactive to the beginning of this month. The magistrate enacted the garnishment as BM apparently told him there was no way she was paying it.

She will not have that spending cash at all. On top of the outlay of $1300.00 a month from her pay, she will no longer be receiving the $1250.00 a month that SO had been paying in cs. She is now down $2550.00 a month total.
