Complicated Court Question
Forums:
DH just lost his job. He's filing for UE and once he is approved (if he gets approved) we will have to reevaluate the current CS orders. I just don't make enough to cover all the household bills and the CS too. The tricky thing is this.
The CS orders are currently filed in the state of CO. We moved out of CO last year and they live in MO. Where to we look at for the correct figures in the right about of CS to pay? CO or MO?
Any information will help. I want to make sure we do the right thing for both parties.
The state that the CS was
The state that the CS was originally processed in.
As far as I know you will not
As far as I know you will not get a break on child support just because you are on unemployment. In Colorado, you get "imputed income" which means if your DH was making $2000 a month before he lost his job, but now he's only going to make $1000 a month on unemployment - the court says that he is capable of making $2000 a month so his income is imputed at $2000 a month even though he doesn't make that much. That's what happened to my BF in Colorado, but on the BM's side.
As far as what state you calculate the child support in, I have no idea whether it's based on where you live now, where they live now, or what state the support was ordered in.
It is whichever state the
It is whichever state the child's support case is in. If it is still in CO and bm never changed it then you all will still be under CO laws. Buy ask an attorney to be sure. It'll be a quick easy free call. Also, you need to get the cs temporarily modified quickly it is a process. And be aware that they will take cs out of his unemployment check too.
If you were asking where to
If you were asking where to look for the calculations, check your state where your order is and it should be available on the computer, then you can just plug in your info, including UE.
