Oh Joy- Contempt Hearing Scheduled Now
As I previously posted, BM got pissed that FDH was laying down boundaries with her so she responding by filing contempt of court charges against him. One item was completely ridiculous but he may end up owing her some money on the two others. I think he has a good case and that he should also file contempt for her keeping the kids away from him and a couple other things including one thing she's claiming he did. The judge needs to see what's really going on here.
Of course, he's known about this since early June and has done nothing. He hasn't looked into what he needs to do to respond. He never filed against her. And now, he has court in two weeks. And he can't afford an attorney.
I can't make him do anything he doesn't want to do. But if his income is further garnished, he better expect to be eating franks and beans with the kids because there is NO WAY I am picking up any financial slack. Not a chance.

She is not wealthy and does not have an attorney.
She is claiming he owes her money b/c he's supposed to pay 70% of out of pocket medical expenses. She has never once provided any accounting of what she's spent. And he pays a lot out of pocket himself. How do judges typically handle cases like this? How can she claim he owes money she's never asked for until she filed papers?
If he owes it to her, I don't
If he owes it to her, I don't have a problem with him being required to pay it. But if I go to a restaurant and there are no prices on the menus and they don't give me a bill, can they sue me and win if I don't pay the amount they expected? You know what I am saying? Perhaps he needs to modify the CO to make sure she presents receipts or something.

My DH had to pay BM $2700 in January for stuff going back to 2008 that she had never documented or asked for prior to being required to pay CS. This included her pool fees so SD could be on a swim team. Poke a snake and you can expect it to strike back.
