Hate dealing with the court!
Here we go again! BM is getting ready to move 8 hours away from the kids and somehow feels that she shouldn't have to pay child support. So FH has to go to court and literally fight to the death to get support for the kids. I'm sure she will not respond to the motion (probably won't even sign for it once she realizes who it's from), she won't go to the hearing, and she won't respond to any communications. And what will the court do? Eventually after postponing the hearings, they will rule that she has to pay support, then say they don't have any up-to-date financial info from her and will try and contact her and she will refuse and meanwhile months will have passed by. Sure arrears will build up, but by this time she will have quit her job once she realizes child support is catching up with her and child support will take another 20 years to find her. She owes a couple of thousand in arrears now but continues to collect a nice big tax return even though she owes money to FH.
During all this, she will be sure to get in plenty of PAS practice on her phone calls with the kids and the oldest will fall for it as usual.
Good guys finish last....especially when dealing with the NJ court system.

That stinks. Why is the tax return not going to the arrears?
There's a definite bias in
There's a definite bias in the court and with the mediators. Even though FH has basically had primary custody since birth, has always been stable, provides them with everything, they almost expect to him prove himself. The last time they went to mediation, he had to tell the mediator twice that he has primary custody and BM only has them two weekends a month. She kept thinking BM had them even though he told her and it's in their case file. She even told FH that it was okay for BM to leave her kids to move 8 hours away (even though BM doesn't have any job prospects)...sometimes people have to do what they have to do. Somehow I feel that if the sexes were switched, she would never uttered those words in defense of a man.

We have no idea. They even sent out paperwork for him to register (and he did) so that when she gets a tax return it gets taken, the arrears get reported on her credit, etc..
I suspect it has to do with her name. When they got married, she took his last name but didn't legally change it. She still uses it today and uses it with the court however, she doesn't use it to file her tax return or her payroll with her jobs because technically it's not her legal last name. My FH has called the courts to find out whether that has anything to do with it but they said it goes by her SSN. We can't think of any other reason why she continues to get away with this.
It's just ridiculous.

If she does file taxes, she could be doing it in late January or early February. We try to file ours as early as we can every year and the one year we were 'behind' we got the letter stating that they were taking our taxes for back support after we had gotten and spent our taxes.
