CS and Graduation

ICanMakeIt's picture

A fellow SM I work with is wondering if her husband will pay an entire extra month of CS for his 19 year old son due to his graduation date being the 3rd of June.

She said the school district ends school for the Seniors a week or two before the rest of the school and the ceremony happens to fall on the 3rd of June despite them being done, all items turned in (chromebooks, library books, etc) a week or two earlier.

I assume they will have to pay for all of June, but told her I'd ask the experts that maybe have had real life experience.

The CS order should give an exact end date for "post-majority support." My SS turns 18 in March 2030, but our CS order requires us to pay CS until 5/31/30. If their order doesn't specify, he should call the FOC.

I would probably assume that barring it being specifically dated. that the CS would be owed for the full month of June.. the child is still not graduated at that point.  I did a little googling and it does not appear that CS is prorated.. though it may be when the order is originally given for the first month.  It's likely for the full month of the date that is stated as the end.. he graduates in June.. that is the last full month paid.

I would just be glad it wasn't required till 21 lol..

rather that "finish with classes".

Cs is a weekly thing here not monthly. Check your agreement, the paperwork should give a termination date or say something like "until 19 or graduation whichever comes first'

either way you can't stop paying until you get official release Sad

Ours was an until 18 or graduation whichever comes last order.  Unless the kid is a university or technical school student in which case the kid can require that CS continue until age 21 though after 18 or HS graduation payments go straight to the kid rather than the CP.  Our son let the SpermClan guilt him into not keeping them on the hook for  years.

The SpermClan was a PITA the entire 16+ years we lived under the CO.  PASing SS as much as they could as the NCP side, piece mealing CS payments until we finally had direct payroll withholding invoked by the courts, crying, whining, and blathering about how hard it was to pay the whopping ($110/mo, then $133/mo) that was in place for 9+ years.  They lost their peanut sized minds when it was raised to $785/mo after Spermidiot refused service for a CS review hearing, ran from the Constable attempting to serve him after he refused multiple registered main service attempts, etc....

Geneherally COs end CS on a specific B-day or upon HS graduation. If the date of graduatio has not arrived, the kid hasn't graduated.

My guess is that in this case, June CS will have to be paid.  Since the Skid will be graduated in June, no July payment will have to be paid unless the proper end of CS filing is not filed if required in your State.

This might vary by state. Probably best to ask a lawyer, unless the fee to do so would be more than the child support!
