Custody/Guardianship
Forums:
BM signed over physical custody to DH in Aug. 09 and at the same time signed notarized guardianship papers for both DH and MYSELF over SD15 so that I was able to handle enrolling her in school for 09/10 school year.
Since we have notarized documentation giving ME guardianship of SD15, does that mean that I can also have a say in court when we revisit the custody issue????
If not, how can I be able to speak freely (without having questions directed to me as a witness) in court where I can explain to the judge why it's better for us to have custody??????
My DH just got physical
My DH just got physical custody of his SD15 in Aug. and my DH signed & notarized a paper giving me the same rights as a guardian for SD15. As far as your BM having to do that for your DH or you, she didn't need to. Once she gave custody to your DH, he didn't need any other paper signed by BM, but the custody paper. And your DH could have signed & notarized a paper giving you the rights of a guardian. As far as speaking freely in court, I am not sure. We have not had to go back to court for anything as of yet. But if you find anything out about that, let me know. And if I find anything out about it, I'll let you know.
