Me having to foot the bill for his CS????

Hey Everyone,
I have a quick question that I have no idea what the answer to it is. My FH works out on a boat so he does have a dangerous job. If something was to happen to him (Say he got hurt and couldn't work so he cant pay his CS) and BM takes him back to court when we are married could the court factor in my income as well? This may seem really caty but I am NOT going to be paying for a kid that didn't come from my body, not to mention BM gets a insane amount of money from FH.

No, what would happen is that when he does work again he will pay back child support. But lets just say he stops paying CS all together and you two are married, then YES they can garnish your wages. If it ever happens that he gets laid off or get workers comp etc. its best that FH notifies attorney general before BM can report it. He can then have the option to send he money to Attorney General to send to BM or he can wait until he goes back to work and then pays back child support.
Always remember NEVER to give the BM a check or money order because she can say it was a "GIFT" and not CS. If not garnishing from paychecks then send payment to attorney general they will sent it to her.

Your income cannot be directly used in the calculation of child support. However, as in my case, depending on what state and county you live in your income can be a factor in adjusting CS in either direction.

In my case the courts have from day one given SpermDad a break on his child support because "StepDad earns a significant income and SpermDad should not be penalized by having to supplement an already artificially elevated standard of living for the kid"....... So, SpermDad gets a $1000.00/Mo reduction in his income, CS is calculated on the lower monthly income, all because I am successful and the DipShit SpermDad is a toothless moron.

In the relative scheme of things this only reduces his CS obligation by about $50.00/Mo but it is the principle that pisses me off. HE gets a break because I am not a scumbag idiot. Hmmmmmmmm? Another example that our Family Court systems are staffed by the bottom 10%er idiots of the legal profession and that includes not only the clerks, lawyers and CPS dipshits but also the idiots in the stupid black robes.

Only in Jersey!

In most other states if income is voluntarily avoided then the CS liability is calculated on the deadbeats earning potential and not on actual income. A spouse's income is not leveraged to pay CS. The deadbeat accrues the liability for back CS. The Spouse does not share in the liability.

At least that is what my TX and OR attorneys have told me.

Only is Jersey are normal or at least tentatively rational decisions completely abandoned. I have worked in Jersey for years and many of my employees have had ongoing monumental battles with the black robed idiots in the New Jersey family court system. Apparently having a business card with any reference to Family Courts, CPS or Child Support Services in New Jersey sucks the brain out of just about anyone.
