That didn't work!!!!!!
Telling on the BM didn't work!! I told the county sheriffs office that she lives in that she is driving with no license, insrurance, registration and expired tags and still nothing!!
How do I get this woman caught!!!!!!!! The only way to save these children is to make her learn a hard lesson and go to jail. The sad thing is, she will not come into this state at all because she will be arrested. She is running from her problems and it is only a matter of time that she is caught, but in process, she is ruining the children. What can we do???
He has visitaion on every other weekend and it states in the papers that he is to pick them up at home and return them. Everyone thinks that she is being nice by meeting us half way but the thing is, is that she is running from the law and if he tells the state that she isn't following the rules by living outside the state then, she will be detained. It is a huge mess that is a catch 22. My main concern is the children.this is how it is:

she is to get child support through the state registry which she hasnt done yet.she lost her license and cannot get a new one because she has tickets she didnt pay. She lives in another state which she did it illigally. She doesn't take good care of the kids and works at a bar part time because there are only 3 businesses in the town she lives in. she is on welfare and working under the table too. She has 2 warrents for her arrest in this state, therefore that is why she won't meet us up here.
All this leads to the kids telling us horrible storties. Do you think that we have the right to keep the kids if she is driving with no license, registration or insurance?? DH thinks he will get into trouble with the law if he does so.
Is this true or can we catch her by telling the sheriff when he comes to the house to get the kids via by her calling them, do you think that we can just tell the cop that we fear for the kids and this is why????

I would call CPS or DSS in the state in which she lives. Tell them about her driving them about w/no license, reg. and ins... tell them the stories the children are telling you.. and they will hopefully get the cops involved..

I don't want to be a downer, but I don't think driving without a license/insurance etc. is gonna be enough for you to keep the kids, and it certainly wouldn't be legal for you to do it without a court order of some kind.
My SD's BM is a complete idiot and DSS had opened investigations on her over a dozen times before she finally did something bad enough that she lost custody to my DH. She was arrested for selling cocaine - was dropping it off to a 'customer' with SD in the car with her. It took THAT MUCH before she lost custody.
The system is definitely fricked up.

It's odd that the cops her county didn't do anything.
Okie dokie, I'm going to tell you what I did before. I walked into the Sheriff's Office and asked for the officer on duty. I told the officer on duty about someone driving with an expired license from a different state, that this person had lived in the new state for over X amount of time (which is illegal in our state not to get a new state license after so many days), the residence the person was living at and what time this person should be home. It took this same officer a few tries but he finally caught this person.
I'm not sure if the county is as strict as the one I used to live in though. My county was pretty strict---even stopping people for expired decals that had just expired the day prior to the pull over.
I do agree with getting DSS involved. However, I think I would leave out the part about BM working at a bar. People have to work, kiddo, even if it's not the most reputable job. Unless BM's coming home drunk to the kiddies I don't think that one fact will sway DSS or a judge to grant you guys full custody.

Our BM was driving with a suspended license because of a DWI. We withheld SD, but only after contacting our attorney to get paperwork done asking the courts to keep Sd in our possession until a hearing.
A judge granted the order, and at the hearing for temporary orders DH was declared "sole managing conservator" and BM has supervised visits in our home until she gets an occupational license.
Every case is different, BM does have a conviction for assault fron early last year, and her mom beat her up and she moved to another house with a non relative. It all plays in I'm sure, but my point to you is do what you and DH feel is right for the kids. BM is now trying to get DH punished by the courts for denying her possession time, once when her mom beat her and she wanted SD back at that house, and then again when we found out about her violence and DWI. Our attorney told us that yes, we were in violation of the orders, but no orders overide the safty and best interests of the child.
I think as long as you do your research and find out what might happen when she gets caught you will have covered your bases. I found that if BM got caught driving on a suspended license she would have been arrested. If SD was with her, SD would have been taken into the custody of the police or CPS until someone could come get her. I get sick thinking how aweful it would have been for her, she's only 3!
WE aren't afraid of this hearing set for Friday. We know what our intentions were and four judges have already ruled in agreement with our thinking.
Do what you feel is right. Not for BM because she needs to learn a lesson because believe me, she won't, but think of the kids and follow your heart.
