child support...is it worth it?
So I haven't posted because other than an annoying BM I really have no issues within our family. But now I am wondering about the fight for child support and could use some feedback from those that have been in a similar situation. My DH has sole custody of his two children and BM was recently ordered to pay CS- we haven't recieved anything in a couple months and its always excuses of why she is unable to at least financially provide for her children. So my question is, is itworth the battle of court or should we just let it go until she is further in debt? Financially, my DH and I don't need her income to support the children at all....its really just the point and also hope that she eventually steps up in being a parent in some way. Thoughts? TIA
If it is going through the
If it is going through the Child Support collection agency and there is a Court Order that states what she is supposed to pay, there is really nothing more to be gained through the court system.
My DS's father is still paying his back support. He still owes over $15K and my DS is almost 23! So, it will come eventually. Until then, they won't do squat about it unless it's been years and years and they haven't paid a dime. If they have paid anything at all, they won't even pursue it.
At least in my state. You can always talk to a lawyer who has an initial consultation free.
May I ask which state your
May I ask which state your in? I've heard negative things about involving those agencies. And its not a matter of her not being able yk afford the payments its her choice to ignore the order and spend money elsewhere that is so irritating.
In our state my DH was told
In our state my DH was told to file with the Court and there will be a hearing. At which point the judge will reissue the order and if she fails to pay again then she could be held in contempt (selfishly I like that idea cause shes a POS). We had the consult with an Attorney just conflicted on what to do next. Its amazing how some people think CS and following a CO are optional.
If she has a job, it's worth
If she has a job, it's worth contacting someone to find out what you need to do to get her wages garnished. Even if she quits, the garnishment will carry on to her next job.
In our state, a judge has to court-order the garnishment. That may not be the case everywhere.
My nephew's father (sister's 1st kid from past bf) has never paid a dime in CS. He owes over $17K and dodges the system. There are warrants for his arrest in 2 states, but those apparently aren't strictly enforced. Hopefully it's different for you!
If you're a man and you don't
If you're a man and you don't pay CS Holy Hell...you are the scum of the Earth because you should pay for your kids blah blah blah BUT GOD FORBID if a BM has to pay ANYTHING for HER KIDS and if she doesn't pay then it's oh well no big deal better luck next time!!!
I FUCKING HATE THAT BULLSHIT DOUBLE STANDARD!!!!!!!!!!!!
Oh I know it makes me sick
Oh I know it makes me sick the double standard for women, then BM had another baby and it made her feel even more entitled that she doesn't have to pay, then she gave her son excuses why she wont pay. Almost like she was proud that she was getting away with it. The state did take her for non payment at the 2 year mark, but she was ordered to pay once again, and CS was raised about 100.00 for medical expenses. She still never paid. So far she owes $17K.
Doesn't matter she will try to draw social security one day, and that will be garnished she can't hide for ever. I watched men that same day we were in court with her, and the men were loosing their drivers license, going to jail all she got was a warning to pay. It's a jacked up system.
Hell, I never was issued a
Hell, I never was issued a warning to pay! They automatically deduct it out of every paycheck and have even sent my tax refund to ex...
I agree especially since I'm
I agree especially since I'm a BM and pay CS to the tune of $500 a month and my ex STILL won't buy my DD15 clothes and feminine hygiene products! Instead, he pays for his fucking girlfriend's Jeep!
I really think that CS should
I really think that CS should be enforced. We all have to be responsible for our children, financially and emotionally. If we were discussing a BD that wasn't paying CS we'd be all over that, a BM should have to pay also!
