he did get some money in a settlement and thats in a checking account under his mothers name.dont think there is much left tho
I'd request 50% of the settlement money & have any debt covered 50/50.
The car could go either way or one party may need to pay the other for their part ownership.
Here's a link to paperwork you can fill out yourself...these are the same forms I used with my XH...we had no children & no assets so it was very straight forward. There was a 250.00 filing fee which can be waived if you don't have the money for it but you'd need to prove it.
It was a very simple process for me, I went through Montgomery County here in TX...can't say if it would have been so easy had I been residing in Harris county though I had my ex sign the waiver of service so I didn't even have to pay to have him served. As long as you are both on the same page, it should be pretty painless.
