With all the crap that has been happening to DH and I, I have finally found something that brings me pure joy-At BM's expense.

BM was arrested for malicious mischief 4 and DV 4 back in August of 2010. She spent a night in jail for (some of you may remember) biting her boyfriend at the time on the chest, destroying his house, ramming his truck with her van, running over his dog as she peeled out of his drive way and getting out of the handcuffs. She spent ONE night in JAIL! Thats it! The judge gave her a an 18 month " Agreed Contiuance with Conditions" or, as some of you may be more familar with "Stipulated order of continuance."

Basically, BM had to stay out of trouble for 18 months. No criminal activity and no seeing the ex-bf. If she did happen to meet all the terms of the agreement then the courts would dismiss the case completely. If she did NOT meet the terms agreed upon BM would be sentenced the maxium and found guilty immediately. The judge also waived BM's right to a speedy trial, as well as a jury trial(BM has gotten away with malicious miscief 3 in the past due to a jury trial) The judge specified that for each of the two charges, BM would get 365 days in jail and a $ 5000 fine. Total= 2 years jail and 10000 in fines. DH would definitely get custody then.

In May of this year, BM was arrested and spent ONE NIGHT in jail for Malicious Miscief/DV 4. She went psycho on her parents and destroyed their house. They kicked her out and long story short, BM had a court date back in June for the original 18 month probation. DH went to this court hearing.
The prosecuting attorney mentioned that there is currently a pending violation of her conditional continuance. The Judge ordered another continuance( not sure why ) Fast forward to yesterday. I found out from our district courts website that BM has a court date for Aug. 2nd for her DV against her parents. BM has another court date for Aug. 12th for the violation of the 18 month probation.

I am busting at the seams. I can not wait to see if the judge puts her in jail. I am trying not to get my hopes up, because BM has gotten away with almost every offense over the years, but I cant help being excited! The laws say that if a conditional continuance is violated then the person receives the full original charge, including the maxium jail time and goes to jail that day. They must be escorted with the sherrif and sent to the county jail. I am also excited because BM is supposed to be getting married on August 6th. Not if shes in jail!!!!!

I'm sure I will be writing another blog in a few weeks bitching about how BM got off. Again. But, right now I'm happy and excited. I hope BM gets what she deserves.
