Should we get a prenup?

I know that some states can take income from the stepparent for child custody purposes. I also know that my state is NOT one of those and I found the code today just to be certain, because someone back in my home state told me I should get a prenup to protect my assets from child custody stuff.

So, should I still get a prenup to protect from that anyway? And is there a SUPEr cheap way to draw one up?

Does a prenup protect you from childsupport? I would ask a lawyer.
I know in my state my income cannot come into play unless my DH had to pay and he was unemployed.

In my state it says a stepparent has no duty to pay unless we adopt the child.

I've only seen other income as an 'additional factor' in calculations. A prenup wouldn't have any effect on this, because it asks for HOUSEHOLD income and HOUSEHOLD expenses.

I know That if you file joint tax they will take it! I did it for the first time last year with my DH because he never gets anything back ...he never owes, but only gets like 100-200 but me owning my home and claiming 0 I always get back at least 2k ....we also just had my first son and it would be our first time claiming him....I was so excited about getting the extra cash to get more baby stuff for him .....WELL Sad DH had gotten laid off a while back but got a job in about 4 months he was getting unemployment and cs was taken out of that....BUT he had gotten behind, while waiting for unemployment to kick in.... so feeling sorry for DH never getting anything we filed joint....needless to say that **** got more than half of our/my sons money and then went on vacation!!!!! Pissed me off

You can file injured spouse and get "your portion" of a joint return.
Of course, it's best to pay your CS Smile

We now have two sons, And I will never file joint again, I will give DH some of the money of course, but file together....NOWAY!

Interesting. I think we need to talk with my tax lady because I just don't understand a lot of the joint filing stuff. I have heard a lot of people on here say not to file joint in step situations for those reasons....Argg I wish this stuff was written somewhere in a language regular folk could understand! Smile
