Child support payment was more then expected.

Bm owes over $7000.00 in child support. About 2 months ago my DH got a letter stating Child Support Enforcement was filing a claim against her wages/other income. Usually when this happens she gets paid every other week and we end up getting about $138 every other week.

Well last night I happen to check the automated child support payment system and it said a payment was received in the amount of $345.87. That makes no sense what's so ever. Since she is so far behind, the state always sends withholding orders to her new jobs and tells them the monthly amount to be taken out is a month's worth of support and half a month's worth of support to go toward arrears. Either way you add it up it doesn't add up to this. Not if she gets paid once a week, twice a month, every other week or monthly, it doesn't add up to the amount DH received. I know she probably filed taxes last year because she worked for a few months because we were getting child support. I know she is married, she has a son but her mother had custody of him so she didn't file him on her taxes.

I'm wondering if maybe it was her taxes. The only reason I wouldn't think it was her taxes is because she didn't work that long last year and I don't know if her husband worked at all. Since her mother had custody of her son, I'm sure her mother claimed the son on her taxes and just gave BM the money so that it wouldn't be intercepted for the child support she owes. It could be her taxes and because she is married the payment has been held for the last 6 months, giving her husband time to file injured spouse.

I guess my question is, has anyone received more then expected in child support and if so have you found out the reason why? Just curious.

That is soooo insane!! This is a example of pure sexism and biased opinion in the court system.

It could just be regular income witholding. In our state once you get so far behind they can take like up to 50% of your pay.

In my state since she is so far behind they can take up to 55% of her monthly disposable income. Bit it also says they are only to take out the lesser whether it be monthly at 55% or the months current and half a months worth. The lesser would be the months current support and half month support payment for arrears so it just didn't make sense to me.

She hasn't paid in a long time. She is never a consistent payer. The only reason she paid anything now, or got a job in the first place is because she is being prosecuted for nonpayment and judge threatened he would change her charge from a misdameanor to a felony if she didn't start paying. Even though she is committing a felony.

Seriously! We've gotten a total of $5.00 from BM1 over the past 2 years that SD16 has lived with us. And when she handed DH that %5.00 and said "here make sure that SD16 gets this" you would have thought she was handing him the keys to a Maserati and like she wanted DH to give her a medal or something. Stupid fucktard hoe

I feel the same way. BM hasn't seen or spoken to stepdaughter more then 1 time in the last two years, her own fault. When a measly payment comes through for child support, because she is being FORCED to pay, she acts like she is doing us some kind of fucking favor. It's like bitch you owe the money, you ain't doing us any favors.

When she finally starts to pay and it doesn't last more then a couple months each time, she thinks she is queen fucking Elizabeth and is doing the world good. She seems to think $140 every 6 months makes her an excellent mother.

Lol well I'm glad you got it in perfect timing. The only bond money she has is like $200 because it was always surety bonds and the prosecuting attorney told us they wouldn't make her give up her bond money for child support until she failed to appear again.

Are you sure about the 1/2 months CS towards arrears? I ask because I used to do payroll way back in the day for a temp agency and (at least in my state- NY) the withholding was CS amount and up to 40% max towards arrears.

So if their check was 1000.00 and CS was 200.00 a month and they were in arrears, another 40% could be taken off of the $800.00 remaining thus making their CS payment $520.00. I would have guys in my office in tears because they worked their asses off pulling double shift, working OT etc and more than 1/2 of their check was going to CS. (Granted their fault for falling behind and not keeping their pants zipped to begin with) but still I DID feel bad for them Sad

Yeah I'm sure. She is ordered to pay $199 current plus $99.50 on top of that for arrears. When she would pay it would always come out to that amount which is $298.50. Prosecuting attorney told DH that's what the judge put in the withholding order that she is to pay until her case is closed in criminal court.

This is why I'm so stumped because it doesn't make sense. No matter how I calculate it the payment my DH received is just too much. Could be her tax refund depending on when she filed her taxes. Like I said her husband has 6 months to file injured spouse so maybe he didn't file it and it just now cleared.

I've learned to just roll with whatever comes from the state... While my Ex is up to date now he's been up and down in the past. CSE is usually on top of things here.

You might be getting her taxes, if she filed by paper and then held up the process by trying to appeal the garnish. There's a 90day hold here in MA during which the other parent can appeal if they feel the funds were taken wrongly. I think it takes longer if they appeal... so if she waited until the end of tax season or filed for an extension, and filed in May or June, then had 90 days to appeal, and did file an appeal, you could just be getting them.
