This morning DH and BM had their show cause hearing. BM showed up two minutes before the hearing started. BM's sister sat on DH's side. I think that was a big statement to BM. BM's boyfriend sat in the back of the courtroom.

BM never filed a response. The judge wasn't happy about that. BM tried to say that she is overwhelmed with all her "medical issues, as well as this firvilous case." Yeah right. The judge didn't believe her, nor did she feel sorry for her.

Long story short...BM didn't fight to have SD placed back in her care. She only asked to have DH's current Parenting Plan (EOW and tue. thur. visit) BM claimed that she can not afford supervised visits, but she will pay to stay in a motel room over her weekends so she can see SD.

Judge kept the restraints. Signed the Temporary order until the first of March. Judge pulled up BM's criminal history and saw that along with the long rap sheet, BM was also found guilty yesterday for assault 4. Judge also pulled up BM's other custody case (her parents have temp. nonparental custody of BM's other two kids) and the judge said that the statements and allegations are "very, very disturbing."

This is going to be the same judge DH will see for his threshold hearing. I think BM may make this easy for DH. Today was a very important day in this custody battle, it will be and is the basis for which the judge makes further determinations. I am so happy!!!!!!!!!!!
