OT-if you or your DH pays CS, plz read...issues with TX and maybe other CS and arrears, etc...
While going through some CS stuff this weekend we realized how the states (and of course BMs), sometimes scr#$%#$5 people who pay CS don't bother to keep track of it themselves and end up believing anything the crazy ex says or the courts. So, here is what I found out as I was doing the CS calculations.
CS is usually set as a monthly obligation. Let's say it's 100USD per month.
The CS orders that are sent for garnishment, at least from Texas have 4 amounts on how CS is to be collected.
if you get paid monthly, garnish 100USD per paycheck
if you get paid semi monthly (2 times per month), garnish 50USD per paycheck
if you get paid bi-weekly (every 2 weeks), garnish 46.15 per paycheck
if you get paid weekly, garnish 23.07 per paycheck
What happens? Well, January has 4 Fridays in which you would normally get paid. If you get paid bi-weekly, that would mean you would have paid 92.30 by the end of January. You would be starting the 5th week, which is already February having paid only 92.30, but the order states that you should be paying 100USD per month. So, those AHOLES in Texas start showing that 7.70USD as ARREARS...pretty soon, you haven't really paid what you owe. Pretty soon, you have some crazy BM calling you and telling you that you haven't paid enough. Pretty soon, many just pay up the difference...then June comes and by that time the pay weeks are 3, which means instead of paying 92.30 (just 46.15 two times), you pay 138.45 in CS that month! So in essence, you are really now caught up if not even ahead, but of course, by then neither the BM not CS office is going to come back and give you money back you have already paid in addition the the 92.43 you paid for a few months there.
So, the moral of the story? KEEP TRACK OF WHAT YOU PAY, what the order says and if you get paid either weekly or bi-weekly know that the odds are the CS will be showing you in arrears when you are NOT and the ex might be complaining about not being given enough and you might lose out.
Get this cleared up every single month or as often as you can with the idiots of CS. Of course, in this example the 100USD per month is not what most pay, but it makes things MUCH harder for those who pay 2-3K per month because of course, then the gap in difference is HUGE in the first few months of the year and then the same thing happens later when they take an amount 3 times from paychecks in one month.
Good luck...I know that our idiot BM is already screaming because she didn't get her full money, but we had to check it and make sure it was correct. You see, before DH just believed the idiot and always gave her extra even though I explained it to him...now he gets that every year his ex was scre@#$#$5ing him by him not taking the time to calculate what was really happening.

Yeah in my state you can look it up online what has been paid towards support and what has been sent to the custodial parent. Maybe they have certian websites in other states I dont know. All you need is your case number, last four digits of your social and birthdate..Before my husband got custody of his daughter he was paying support. They would take money out biweekly and it pissed me off! They would show he was behind and he was never behind..It worked itself out in the end. When BM would call and rant saying her check was $20.00 short we told her,"Oh well get over it and if you have a problem you need to call child support enforcement because they are the ones taking over how much I pay and when it is paid." Of course she was to lazy to do it so she would just blow it until the next time she got "her" check...

OAG doesn't just screw the person paying, sometimes it screws the one receiving.
I'm in Texas, receive CS from my ex, they took out too much in his tax return for arrears 3, yes 3 years ago. Received the letter this year to pay the overage back within 30 days and I promply sent a check out. I have never been notified whether they got it or not and whether the account is settled.
Then there is the little thing of me trying to stop CS- as now I have one child and ex has one. They will not stop deductions without having a court order-even though I have signed two forms saying I want to close the CS case. The state is definitely benefitting, you see, I have had CS checks held from direct deposit for more than 2 weeks- simply beause it is still sitting in the state's account acrueing interest.
My wish was that we did not have to involve the state in our divorce- they had complete say how the CS was handle because I went to a free legal service for the indigent- that was all on the ex- he left me with no money in our checking and took all of value we had when he kidnapped our kids.

What does a court order mean? I mean, last time we went to those idiots it was handled at the CSE office and it took almost two months for a darn judge to sign it...or so they claim!
We MIGHT get luck in that it is being deducted now from severance pay and that severance runs out about amonth before they BETTER stop CS...which means they can't garnish more than he will owe...lol

A court order means that we must take it to the judge in the county the divorce was filed in to get the CS order lifted. I have had such a run- around with the CSE unit that where I am at is just sending a full CS check back to the ex as soon as it hits my account. They will not stop it without myself or ex filing a custody change, child support change- which costs attny fees as well as court fees.
You just cannot get them uninvolved!
