CS in Texas - anyone who has had CS stopped in Texas when child reaches 18 or stops going to school, etc.
Has anyone been through stopping CS garnishment in Texas when the child turns 18 and is no longer attending school?
If so;
1. when did you file to stop it
2. how long did it take to get it stopped
3. what about any overpayments that were garnished, how did you get them back or were they as they are supposed to, apply to future CS, etc.?
DH is getting ready for this and we need to know how this works in Texas...thanks!

I am in Texas. My SS turned 18 about 6 months ago.
A few months before SS turned 18, the AG sent a letter to BM and DH to see if there was any reason why the CS should go past his 18th birthday. (They wanted to know if he was still in high school).
The AG stopped it on his birthday, since, neither DH or BM told them any different. It was much easier than I ever thought it would be. We did not have to initiate anything.

Thanks...I guess my worry is that loser turns 18 in September...that means that this so called "letter" will probably be sent out in the summer, prior to school even starting...and of course, crazy witch will probably come up with some darn excuse and say the kid is still in school.
Anyway, what about any overpayment? Was it applied or refunded? The only reason my DH has an overpayment is because the crazy ex lied to the courts years ago about him not paying, so they garnished his wages for arrears. Once it was found it wasn't owed, they didn't return the money to him, as it had already been sent to crazy. They then said that it would be applied at the end. Somehow, I don't buy it. Sigh...
