Custody Modifications-Parenting Investigators..Your experience????

Do any of you ladies out there have experience with a change of cutody and parenting investigators?????

FINALLY DH is talking with a lawyer for getting SD out of the situation. He was going to file all his court papers himself and represent himself in court, but due to all the knew drama with BM and her continuous downward spiral, DH is consulting with lawyer to see if he should file an ExParte order or just a parenting plan modification.

Background: BM is a terrible parent and person who, in my opinion, should just off herself. A few years ago, DH and BM had a nasty custody battle over SD. DH was sooo close to getting her. Even the GAL and parenting investigator said SD should NOT reside with BM due to her various mental issues and anger issues. Long story short, DHs lawyer gave up and at the time DH didn't know what he knows now. BM has a lenghty criminal record and may be going to jail in June for a probation violation. Recently, her parents kicked her and her children out of their house. BM is now staying with a friend a few blocks away from us. The kids are sleeping on the floor and not being taken care of. BM refuses to let SD stay here-in her own bed.-

Anyway, DH found out about this and was going to file an emergency protection order (exparte order) but has decided he really needs to talk with a lawyer first. I was doing some research and found that during custody modifications, if there is a dispute about it, the court usually orders a parenting investigator.

Do any of you out there have experience with this? What will they be looking for? My house is clean, but with a 5 year old and a 2 year old it gets messy quick. Does my house have to be spotless? Are they just seeing how everyone interacts ith the children? What can I do to prepare for something like this?

No experience, but I doubt they expect a spotless house. Picked up and clean, yes, but not spotless. Toys on he floor- ok, poisons, guns, drugs at a kid's reach not so good. Wink (i know you don't have that around!) I would think they'd look to see how your children are- if they are clean, being fed, have clean rooms/clothes. They may check to see if there is food in the home, weapons anywhere, where the children sleep and stepkid would sleep. Check to see if the house is a safe environment for skid. That would be my guess as I have no experience on this. As long as your kids aren't running around with lice smoking cigarettes, I'm sure you'll be fine! Wink

There was a peron I know that had CPS (if I remember correctly) check out BMs. The kids were not dressed or improperly dressed, the house was gross and BM treated them like shit. It didnt matter.

There was tons of thngs a child could get hurt on in the basement,they didnt do anything about it.

I would file it, they want to be sure there is food, a place to clean up and child has there own space.

Lights, water, clean, food, safe, stable enviroment. I'd be sure they went to where the BM is staying too. Be sure Lawyer gets with probation officer, to see about work history and failed drug test. Those things will work in DH favor.

Nothing about a drug test. She violated the terms of her probation by being arrested for malicious mischief...Which is the same thing that put her on probation. Smile
