Secondary charge of violating the restraining order that they.never.got.modified.
And it is BM's fault they both got arrested!

DH did get a direct deposit from the state to the tune of $6200+ of the $6500 BM's original bail. He immediately cut me a check for half of it! Saying I had been supporting the kids with my salary and it was only fair.

Two days before he got the deposit, BM's brother called. Advising DH he wanted his money back. That he only put it up so that BM could get out of jail and DH better cut him a check as soon as it came in to him. Dude: here is your sign, don't bail losers out of jail for non payment of support and expect your 'bail money' back. DH told him to pound sand and get the cash from BM.

Well apparently BM's brother went to see BM on Friday as she had lied to him and told him that DH would give him the money back. The two get into a verbal arguement and BM proceeds to scream at her brother that she will F*ing kill him, while both are standing on their parents front lawn.

Neighbors called the cops. Hours later we get the boohooing call from sd18 that she and BM got arrested and she didnt KNOW that she could not be around bm and she didnt KNOW that she had to go to school and would DH come bail her out.

Dh advised her both he and her uncle (DH's brother) had told her that she couldnt be around her mom until she went to court to end the RO and the paperwork she read and SIGNED agreeing to community control/service instead of me prosecuting her required all hours worked and that she could NOT miss a day of school without a doctors note.

His exact words to her I forget but it was along the ideas of "How's is that whole 'your an adult now and no one can tell you what to do' working out for you?"

No, he did not bail her out. Refuses to. Said he would be a piss poor father if he didnt let her learn this lesson. So she is still in jail. He did say if she isn't out by this weekend he will go visit her.
