OT-Getting name removed from deed
A friend of mine bought a house with her boyfriend a year ago. She recently found out that he has been cheating on her. She wants to get her name off the deed to the house. Is this an easy process?
I feel so bad for her. She has been with this guy for 5 years and was planning on marrying him.

I'm trying to find out if she is on the mortgage. I hope not. I would hate for her to deal with this for years. He has been a complete asshole to her.

Well, I don't know how much of it depends on where you live or anything but here is my experience with this.
DH and BM owned their house. She kept it in the divorce. It said right in the divorce that she was responsible for the house. She couldn't get re-financed because of her credit and when she walked away from the house the divorce decree didn't mean anything. We had to pay lawyers to take care of it and at the end of the day all that happened was that they can't come after our assets but now DH has a foreclosure on his credit for I believe seven years from the date it happened.

My mortgage company made me
My mortgage company made me do a quit claim deed on my first husband when I refused to put him on the mortgage. Lawyer had to draft it. Made it easy when he died. Easy to do, but if she is on the mortgage, that is much harder and the banks make it very difficult. If he defaults, she is screwed.

I am a widow and my DH and my name are on the deed, tax records, mortgage. I refinanced after he died to get out of debt and the bank said I should leave his name on the mortgage. I don't understand how having a deceased person on the mortgage is 'better', but I had to do it.

That's odd. My first DH passed, and because we had a "survivorship" deed, once I presented the death certificate the deed was changed to my name only.

I believe they were able to put down 30,000 and I think he makes more money than her. I think he is going to have to buy her out and refinance.

Or do something so she can get off of the mortgage. I don't think she wants to stay on it for good. Years of work can equal many years of peace of mind.
