BM back in our lives
I haven't blogged much about BM because things had been so quiet since her visitation was removed. DH was working on a plan to get SD13 moved to a special school near our home. It would have combined the counseling that she needs with an education. Also, he has been attending counseling with her, hoping to repair their broken relationship. SD10 has been doing so much better. She has stopped crying all the time and seems excited about school and her activities.
The problem is that we were just informed that CPS gave BM her kids back. According to them, she has been working with them and has provided a safe environment for the kids. She has also been going to counseling. If you've followed me in the past, then you know that SD13 is under BM's care so she is going back to her moms. BM has already let DH know that she is picking her up.
We have full custody of SD10, but now, BM is petitioning the courts for visitation again. DH and I are extremely worried because of all the crap she has pulled (i.e. kidnapping SD10, PAS, etc). Now, we have to go back to court. It just sucks that we were starting to make headway with both of the SDs and things were starting to calm down. I am extremely worried that SD10 will get sucked back into this whole mess.
Our lawyer told us that there is a good chance that she will get visitation, since her caseworker with CPS is going to vouch for her. She also had a therapist that is going to testify. Its so unfair that she can just keep screwing up and they keep on giving her a free pass to do it again.
Of course, DH and I have to go through the emotional toll of another court case, of SD10 being put in the middle of this. And then there is the legal costs. We have spent thousands of dollars on custody already, and now, we have to start over.

DH did ask about supervised
DH did ask about supervised visitation. His attorney says we can ask, but not to expect it. BM is on a plan with CPS where they are regularly checking up on her and visiting her at home. Since they are so involved, he didn't know if a judge would agree to supervised visits, especially since we live 1,000 miles from BM and that would make her visitation with SD10 very restrictive.
He didn't drop the kid off
He didn't drop the kid off and forget about her. We went to court over it. And this is the same judge who told DH that she thought it was best that SD13 live with BM, because she was afraid SD would hurt herself or someone else. That's the wonderful thing about small, rural counties. We always have the same judge.
I highly doubt BM will get full custody. SD10's whole demeanor, health, and school performance changed drastically when she came to live with us.
BM is not the only one with character witnesses. We have plenty of doctors, therapists, and teachers that are willing to testify on DH's behalf, if it comes to that.
